The petitioner is languishing in custody for the offences punishable under Sections 406/419/420/120B/34 of the Indian Penal Code.

The wife of this petitioner is proprietor of the rice mill. There is allegation of non-return of the entire rice of the paddy. The petitioner is in custody since 31.07.2015. Even charges have not been framed in this case which would be evident from the report of the learned trial Judge.

Learned counsel for the Bihar State Food Corporation opposed the prayer for bail.

Patna High Court Cr.Misc. No.61885 of 2017 (4) dt.06-03-2018 P2/ Considering the nature of allegation, which is mainly against the wife of this petitioner and the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gogri P.S. Case No.200 of 2013, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
