Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner has challenged the order dated 28.12.2023 issued under the signature of respondent no.2- Director, Industry Department, Government of Bihar, Patna, by which the petitioner has been censured and it was observed that the suspension of the petitioner will be treated as on duty but he will not be entitled to anything save and except the subsistence allowance.

Learned counsel for the State submits that against the impugned order the petitioner should have filed an appeal.

In these circumstances, this writ petition is disposed of with liberty to the petitioner to file an appeal before the appellate authority against the impugned order. If such an appeal is filed by the petitioner within four weeks from today, the same shall be disposed of by the appellate authority within six weeks from the date of filing of such appeal. The appeal shall be heard and decided after hearing the petitioner by a reasoned order.
