ANJANA MISHRA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kumarkhand P.S. Case No.201 of 2014 for allegedly having committed the offences under Sections 150, 341, 342 and 353 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is general and omnibus allegation against several persons, including the petitioners, who had come to the Block Office in the mob during PACS election and disturbed the B.D.O. in discharge of his duties. Learned counsel for the petitioner further submits that similarly situated co-accused persons,
Patna High Court Cr.Misc. No.47425 of 2016 (2) dt.18-11-2016 2/2 namely, Surendra Yadav and Sushil Kumar Yadav @ Sushil Kumar, have come to this Court in Cr.Misc. No.12693 of 2016 and vide order dated 18.3.2016, they have been asked to surrender as they are already on police bail. Let the petitioners also surrender in terms of the order dated 18.03.2016 and thereafter their prayer for bail shall be considered accordingly.
Let the learned court below consider the prayer for regular bail of the petitioners in view of the ratio laid down in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004(3) PLJR 491, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Kumarkhand P.S. Case No.201 of 2014 pending in the court of learned Additional Chief Judicial Magistrate, Madhepura.
