Mr. Amrendra Kumar, AC to AAG-15 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-10-2018
1. The present application for review/recall of the order passed by this Court passed in Letters Patent Appeal No. 742 of 2016 was called out in the first session. Nobody remained present on behalf of the applicant. Therefore, it was posted in the second session. In the second session also, learned advocate appearing on behalf of the applicant is absent.
Patna High Court C. REV. No.124 of 2018(4) dt.06-10-2018 2/2 However, one Mr. P.N. Mishra, learned advocate, has requested to adjourn the matter as the learned advocate appearing on behalf of the applicant is not in the Court. He is not in a position to point out the reason for the advocate not remaining present.
2. At this stage, it is required to be noted that even while disposing of the main Letters Patent Appeal, the Division Bench in para 1 observed as under:
"A request was made for adjournment in the morning, but it was rejected on objection raised by the respondents representing the State of Bihar, the Patna University and the National Institute of Technology, Bihar. It has been pointed out that the appellant is dragging the matter without any reason."
3. As there is no valid reason shown for adjournment, the present application stands dismissed for non prosecution. (Mukesh R. Shah, CJ) (Rajeev Ranjan Prasad, J) Sunil/-s.shukla U
