2. The petitioner apprehends arrest in a case registered under Sections 108 and 61(2) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, it is alleged that the daughter of informant namely Aisa Kumari aged about 15 years took admission in Parwati Girls Hostel. It is alleged that on 01.08.2024 at about 02:26 P.M., bhagini of informant namely Khwahish Kumari called him through mobile phone and told him that something has happened with Aisha and she is not being allowed to go there. Thereafter, informant called the hostel in-charge/petitioner on his mobile upon which petitioner replied that his daughter has committed suicide. It is further alleged that whole responsibility of this crime lies on the hostel

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that it is evident from the CCTV footage that no one entered in the room of the deceased girl. During course of investigation it has come that in May 2024, an allegation of theft was made against the deceased girl due to which her father/informant came to hostel and starting beating her in front of the other hostelers present in the hostel. Due to this kind of act of her father, she was in depression and committed suicide. Petitioner has no concern with the alleged occurrence and he has been made accused in this case only on the ground that he is in-charge of the hostel. Petitioner claims clean antecedent.
5. Learned counsel for the State opposed the bail application.
6. Having considered the aforesaid facts and circumstances of the case as well as the material available on record, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below

No.71262 of 2024(4) dt.09-01-2025 3/3 within a period of eight weeks from today, on furnishing bailbond of Rs. 10,000 (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, Muzaffarpur in connection with Mithanpura P.S. Case No. 231 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. 2023. (Prabhat Kumar Singh, J) utkarsh/- U T
