JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-07-2023 This application has been filed for modification of order dated 08.12.2021 passed in Cr.Misc. No. 58997 of 2021 to the extent of extension of period of surrender. It is submitted on behalf of petitioner that earlier petitioner was granted provisional anticipatory bail by order dated 08.12.2021 passed in Cr.Misc. No. 58997 of 2021 whereby learned Court below was directed to confirm the provisional bail of petitioner on certain terms and conditions and petitioner was directed to surrender before the learned Court below and furnish bail-bond within a period of thirty days from the date of receipt of said order, but since petitioner was working as labour in Delhi, he could not surrender and furnish bail-bond within time.

No.68963 of 2022(2) dt.12-07-2023 2/2 In view of aforesaid fact, further four weeks time from today is granted to the petitioner to surrender and furnish bail-bond before the court below and learned Court below shall examine and confirm the provisional anticipatory bail of petitioner on the same terms and conditions.

Accordingly, order dated 08.12.2021 passed in Cr.Misc. No. 58997 of 2021 is modified to the aforesaid extent only and this petition is allowed.
