Petitioner, already in custody, seeks bail in connection with Kadirganj P.S. Case No.76 of 2016, registered under Sections 147, 148, 149, 341, 342, 323, 325, 397, 379 and 302 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner and the informant side are agnates, there is dispute of share of the land and allegation against the petitioner is general and omnibus. It is further submitted that the entire family members have been implicated, the petitioner is 75 years of age and other co-accused, similarly situated, Lal Mohan Yadav @ Lal Mohan Prasad has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No.52080 of 2017 on 10.11.2017.

Patna High Court Cr.Misc. No.57531 of 2017 (2) dt.13-12-2017 2 /2 Having considered the said facts and circumstances, let petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi, Patna in connection with Kadirganj P.S. Case No.76 of 2016.
