1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Ramnagar Police Station Case No. 373 of 2022, dated 30.07.2022, disclosing offences under Section 379 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that the motorcycle of the informant was stolen from parking shed. The informant came to know that the same has been stolen by one Nippu Yadav.

4. Learned Counsel for the petitioner submits that the name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused Nippu Yadav. He next submits that another co-accused Subhash Yadav @ Subhash Kumar, whose name has also transpired on the

Patna High Court CR. MISC. No.74292 of 2023(3) dt.21-03-2024 2/2 basis of confessional statement of co-accused Nippu Yaddav, has been granted anticipatory bail by a Coordinate Bench of this Court in Cr. Miscellaneous No. 19328 of 2023.

5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused has been granted bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagha, West Champaran, in connection with Ramnagar Police Station Case No. 373 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
