2. The petitioner seeks bail in a case registered for the offence punishable under Section 394 of the Indian Penal Code and later on, charge-sheet has been submitted under Section 395 and 412 of the Indian Penal Code.
3. Earlier, the prayer for grant of bail to the petitioner was rejected by this Court vide order dated 14.02.2025 passed in Cr. Misc. No. 80037 of 2024.
4. The prosecution case in brief is that on 18.02.2020, three miscreants, armed with weapons, entered into C.S.P. Office and on the point of arms, they took the informant and his staff in their custody and took away Rs. 1,60,000/- from the cash counter and looted bank passbook of the customers. They

5. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R.. Name of petitioner transpired during investigation, merely on the basis of confessional statement of co-accused Suman Kumar Bhagat, who has already been granted bail by this Hon'ble Court vide order dated 11.11.2020 passed in Cr. Misc. No. 28493 of 2020. Save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged offence. No incriminating article has been recovered from possession of this petitioner. Co-accused Nawal Sahni, having similar and identical allegations has already been granted bail by this Hon'ble Court vide order dated 26.10.2021 passed in Cr. Misc. No. 35741 of 2021. Till date, petitioner has not been put on T.I. parade. Moreover, charges have already been framed against this petitioner vide order dated 29.05.2023. Petitioner is in custody since 24.03.2023.
6. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
7. Considering the facts and circumstances of the case, slow and tardy progress of trial, claim based on parity and
Patna High Court CR. MISC. No.64696 of 2025(3) dt.19-12-2025 3/3 period of custody, the prayer for grant bail of to the petitioner is allowed.
8. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeIV, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No.29 of 2020.
