This application for grant of regular bail arises out of Dumra P.S. Case No.466 of 2022 registered for the offence punishable under Sections 20(b)(ii)A of the NDPS Act. 3.

The recovery is of 250 grams of ganja from the possession of the petitioner.

It has been submitted by learned counsel for the petitioner that the recovery is of small quantity of ganja for which maximum sentence is one year and maximum fine is Rs.10,000/-. The petitioner has already undergone the sentence of more than one year as he is in custody since 21.09.2022. 5.

In these circumstances, this bail application is disposed of with direction to the Special Judge, Sitamarhi to

Patna High Court CR. MISC. No.66766 of 2023(3) dt.06-12-2023 2/2 pass necessary orders in accordance with law within one week from the date of receipt/production of a copy of this order without detaining the petitioner any further for having been in possession of small quantity of ganga and thereafter file a compliance report to this Court.
