====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 03-12-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Gopalganj P.S. Case No. 341 of 2019 for the offence registered under Sections 447, 341, 323, 379, 386, 504 and 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and frivolous. Petitioner had purchased a piece of land from one Ram Chandra Pandey with whom the informant was having a dispute, therefore, the name of the present petitioner has also been drawn in connection with the present case. Learned counsel for the petitioner submits that admittedly there was some dispute

Patna High Court CR. MISC. No.61000 of 2019(3) dt.03-12-2019 2/2 regarding construction of boundary wall over the land in question. On the said date, the petitioner was not present in Siwan and was outside the State. Learned counsel for the petitioner further submits that the petitioner shall cooperate with the investigation and be present on all dates as and when required during the course of trial.

Considering the aforementioned facts and circumstances and the allegation against the petitioner that he had fired but it had not hit anybody, and also that the petitioner has a clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj P.S. Case No. 341 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
