2. The petitioner seeks bail in a case registered for the offence punishable under Sections 316(2), 319(2), 318(4), 338, 336(3), 340(2) and 3(5) of the B.N.S.

3. The allegation in the First Information Report is that 15 Bank Passbooks and 18 A.T.M. Cards, in the name of several people, were recovered from the possession of the petitioner, while he was detained by the local persons.

4. Learned counsel for the petitioner submits that it would be evident from the First Information Report itself that the petitioner has not been found using the said A.T.M. Cards which were recovered from his possession and no one has even complained of the fact that the petitioner has used his A.T.M. Card or the Passbook of the Bank account of any other person. It further appears that the main accused of this case are Md. Salim

Patna High Court CR. MISC. No.67704 of 2025(3) dt.19-12-2025 2/2 and Md. Saif, who used to cheat innocent persons and so far as the present petitioner is concerned, there is only allegation that he was found in possession of the A.T.M. Cards and the Bank Passbooks. The petitioner is in custody since 15.06.2025 and charge-sheet has already been submitted. Further, petitioner has no criminal antecedent.

5. Learned APP for the State opposed the grant of bail on the basis of allegations made in the First Information Report

6. Taking into consideration the facts and circumstances and considering the fact that there is no allegation against the petitioner that he was seen or found using the A.T.M. Cards coupled with the fact that charge-sheet has already been submitted in this case, let the above named petitioner, who has no criminal antecedent, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar, District-Kaimur/concerned Court below in connection with Katihar Sahayak P.S.
