The petitioners are mother-in-law and father-in-law of deceased who are accused in Bhagwanpur Hat Police Station Case No 148 of 2017 registered for the offences punishable under Sections 304B/34 of Indian Penal Code.
Counsel for the petitioners submits that the investigation in the case is complete. Charge sheet has been submitted against the instant petitioners. It is also submitted that the petitioners are in custody since 26.06.2017. It is further submitted that in fact the first information report has been lodged at the instance of the grandfather of the deceased mala fide even though the deceased succumbed to her ailments during course of
Patna High Court Cr.Misc. No.55107 of 2017 (2) dt.12-12-2017 2/2 treatment.
Considering the aforesaid submission, prayer for bail is allowed. Let the petitioners above named be released on bail on each of them furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate II, Siwan in Bhagwanpur Hat Police Station Case No 148 of 2017 dated 26.06.2017 subject to the following conditions : (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.
(ii) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
