2. The petitioner seeks regular bail in connection with Barhara P.S. Case No. 35 of 2023, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 325, 504 of the Indian Penal Code.

3. As per prosecution, altogether 20 persons are said to have assaulted the deceased but only one injury has been found in the postmortem.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner has got no criminal antecedent and he is jail since 12.06.2023. Postmortem does not corroborate the F.I.R.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Barhara P.S. Case No. 35 of 2023.
