The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 409 and 120B of the Indian Penal Code.
The petitioner was in-charge of the PACS. He had withdrawn Rs.9,00,000/- from the account to purchase paddy. However, paddy was not purchased.
Petitioner has stated on oath that he has already deposited Rs.9,00,000/- (rupees nine lacs) in the credit of the bank account from which money was withdrawn.
Learned counsel for opposite party no. 2 submits that in fact the petitioner had deposited the same amount. Let the petitioner, above named, in the event of his
Patna High Court Cr.Misc. No.50220 of 2016 (5) dt.24-03-2017 2/2 arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea/Successor Court in connection with Sadar (Mufassil) Police Station Case No. 283 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
