2. In this case, the petitioner is seeking regular bail in connection with Desari P.S. Case No. 284 of 2024, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per prosecution case, total 300 liters of country made liquor was recovered from the motorcycle of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. He further submits that the petitioner has clean antecedent and is under custody since 20.08.2024.

5. Learned APP for the State has opposed the prayer for

Patna High Court CR. MISC. No.68799 of 2024(2) dt.07-10-2024 2/2 bail.

Considering the above-mentioned facts and circumstances especially the clean antecedent, the petitioner, abovenamed be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1-cum Additional District and Sessions Judge, Vaishali at Hajipur in connection with Desari P.S. Case No. 284 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
