The petitioner apprehends his arrest in connection with Sheikhpura (Hathiyama) P.S. Case No. 80 of 2011 registered under Sections 420, 406 and 409/34 of the Indian Penal Code. The accusation is that, on inquiry, the construction of building of Middle School, Awdhe was found sub-standard. The said building was constructed under the supervision of Head Master of the said school, Junior Engineer and the Technical Supervisor (petitioner).
Learned counsel for the petitioner submits that the building was constructed in the financial year 2008-09 and regarding sub-standard construction of building, a report has been

It is further submitted that petitioner joined as Technical Supervisor in February, 2009 and he has no knowledge about the construction of the said building. It is further submitted that co-accused, Ajay Kumar, who is the Assistant Teacher-cum-Secretary of the said school, has already been granted privilege of anticipatory bail by this Court vide order dated 07.03.2012 passed in Criminal Misc. No. 31566 of 2011. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Hathiyama) P.S. Case No. 80 of 2011, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
