The petitioner prays for anticipatory bail in connection with Nathnagar P.S. case no. 107 of 2016 registered for the offences punishable under Section 307/04 of the Indian Penal Code.
It has been submitted on behalf of petitioner that other co-accused fired on the informant and except his name in F.I.R., no overt act has been alleged against him. Heard learned A.P.P.
Having heard both sides and in the facts and circumstances of the case stated above and as there is no overt act against him, let the abovenamed petitioner, in the event of his
Patna High Court Cr.Misc. No.48234 of 2016 (2) dt.16-12-2016 2/2 arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar P.S. case no. 109 of 2016 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
