2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126 (2), 78, 115 (2), 65 (1), 352, 351 (2) and 3 (5) of the BNS and Section 4 and 6 of the POCSO Act.
3. The case of the prosecution is that the petitioner was followed the minor daughter of the informant. It is alleged that on 11.11.2024 at 11:00 A.M. , the petitioner took the victim in a room and established physical relationship. It is further alleged that he had also made a video and photo viral and was also blackmailing her. Thereafter, daughter of the informant disclosed this to the informant. Hence, the present FIR.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.66116 of 2025(4) dt.28-11-2025 2/3 petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR itself it is clear that the occurrence is of 11.11.2024 whereas the FIR was lodged on 11.05.2025. There is almost delay of six months in filing of the FIR for which there is no explanation. During the course of investigation, the statement of the victim was recorded under Section 183 of the BNSS wherein she has stated that the petitioner was following her and she was on talking terms but when the family members came to know this fact, she stopped talking. Despite that, the petitioner kept an eye on her on 11.11.
2024 he took her in a room and established physical relationship with her and after that he threatened her of dire consequences. It is further contended that no medical examination of the victim was conducted and the delay which has been caused in filing of the FIR creates serious doubt. Moreover, the petitioner is languishing in judicial custody since 0.06.2025 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on
Patna High Court CR. MISC. No.66116 of 2025(4) dt.28-11-2025 3/3 bail. The above named petitioner is directed to be released on bail in connection with POCSO Case No. 76 of 2025 arising out of Nalanda Mahila P.S. Case No. 69 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IV, -cum- Exclusive Special Judge (POCSO), Nalanda at Biharsharif/concerned Court.
