Petitioner is languishing in custody for the offences punishable under Sections 363/366A/34 of the Indian Penal Code.

The accusation of kidnapping the minor daughter of the informant is against the petitioner. The petitioner is not named in the F.I.R. His name transpired in the statement of the victim under Section 164 Cr.P.C. wherein she has stated that she had married with one Ajay Kumar. In her subsequent statement the victim has stated that she had filed a petition before the learned Court-below that she has wrongly

Patna High Court Cr.Misc. No.48201 of 2016 (3) dt.23-01-2017 2/2 named the petitioner in her statement under Section 164 Cr.P.C. The aforesaid fact reveals from the order dated 24.02.2016 passed in Cr. Misc. No.39896 of 2015.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Samastipur/Successor Court, in connection with S.T.
