The petitioner is apprehending his arrest in connection with Tarari P.S. Case No. 53 of 2014 for the offences instituted under Sections 341, 323, 504, 506 and 34 of the Indian Penal Code and under Sections 3(x) of the SC/ST Act.
As per prosecution case the informant Mohan Ram the husband of Mukhiya Urmila Devi was going at Tarari for some work. In the meantime at about 5:00 p.m. this petitioner and other two persons started abusing in the name of his caste and assaulted by fists and fled away.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case due to
Patna High Court Cr.Misc. No.48626 of 2015 (2) dt.03-02-2016 2/2 political reasons. Wife of the informant is a Panchayat Mukhiya against whom the family members of the petitioner had contested, hence the accusation has been levelled. Other co-accused have been granted bail vide Cr. Misc. No. 45032 of 2015. On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Tarari P.S. Case No. 53 of 2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
