2. The petitioner seeks regular bail in connection with Session Trial No. 295 of 2023, arising out of Rosera P.S. Case No. 373 of 2022, registered for the offence punishable under Sections 395, 397 and 412 of the Indian Penal Code.

3. As per prosecution, the F.I.R. was registered against unknown for dacoity. The petitioner has two antecedents in which he is on bail. He is in custody since 10.01.2023.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He is not named in the F.I.R. there is no recovery of any material from the petitioner.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.67291 of 2023(2) dt.17-10-2023 2/2 for bail.

6. Considering the aforesaid fact, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-1, Rosera, Samastipur, in connection with Session Trial No. 295 of 2023, arising out of Rosera P.S. Case No. 373 of 2022.

8. This is also subject to the condition that the petitioner shall mark his presence in Rosera Police Station, District- Samastipur on first and third Sunday of every month, failing which, his bail bonds shall be cancelled by the court below.
