2. The petitioner seeks bail in Taraiya P.S. Case No. 331 of 2024 registered for the offence punishable under Section30(a) of Bihar Prohibition and Excise Act.

3. Allegedly, two persons including the petitioner sitting on a car were arrested by the police and on search, 76.86 litres whisky was recovered from the car.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is a person of clean antecedent. The petitioner is a driver by profession and on the request of coaccused, he was driving the vehicle, in question. The petitioner

Patna High Court CR. MISC. No.67794 of 2024(2) dt.26-09-2024 2/2 has got no concern with the said car or the recovered liquor except that he was driving the car with a valid driving license at the relevant time. The petitioner is under incarceration since 0908-2024.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, especially, the clean antecedent of the petitioner, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Special Excise Judge, Saran in connection with Taraiya P.S. Case No. 331 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
