Mr. Sanjay Kumar Tiwary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 17-09-2025 Heard Mr. Vinod Kumar, learned counsel appearing on behalf of the petitioners and Mr. Sanjay Kumar Tiwary, learned APP for the State.
2. The petitioners seek pre-arrest bail in connection with Konch P.S. Case No. 341 of 2025 registered for the offence(s) punishable under Sections 190, 191(2), 191(3), 126(2), 115(2), 118(1), 109, 303(2) of the Indian Penal Code.
3. At the outset, learned counsel appearing on behalf
Patna High Court CR. MISC. No.65404 of 2025(2) dt.17-09-2025 2/3 of petitioners has informed that the petitioner nos.1, 4 and 6, namely Indradeo Prasad @ Indardeo Bhagat, Ramali Bhagat @ Bali Pal and Ajay Bhagat @ Chhotaka Babu, respectively, have already been arrested and seeks to withdraw the anticipatory bail application filed on behalf of them.
4. Permission is accorded.
5. As per the allegation made in the FIR, the petitioners along with other co-accused with a common intention to kill the informant and his family members causing them injury and they also stolen 82 sheep of the informant.
6. Learned counsel appearing on behalf of the petitioners submitted that petitioners are innocent and they have falsely been implicated in the present case. The petitioner nos.1, 4 and 6, namely Indradeo Prasad @ Indardeo Bhagat, Ramali Bhagat @ Bali Pal and Ajay Bhagat @ Chhotaka Babu, respectively, have already been arrested during the pendency of the present bail application. So far as, the petitioner nos.2, 3 and 5 are concerned a general and omnibus allegation has been leveled against them. The petitioners have clean antecedent. On these grounds, the petitioners seek to be released on pre-arrest bail.
7. Learned APP for the State vehemently opposed the
Patna High Court CR. MISC. No.65404 of 2025(2) dt.17-09-2025 3/3 prayer for grant of pre-arrest bail.
8. Having considered the rival submissions made on behalf of the parties, as well as, a general and omnibus allegation has been leveled against the petitioner nos.2, 3 and 5, I am of the opinion that petitioner nos.2, 3 and 5 have, prima facie, made out a case to be released on pre-arrest bail.
9. The petitioner nos.2, 3 and 5, above named, are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Gaya in connection with Konch P.S. Case No. 341 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
10. The learned District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases, as what have been stated in paragraph No.3 of the bail application, this order will automatically lose its force.
