The grievance of the petitioner in the writ application is indecisiveness on the part of the respondents in the matter of grant of promotion to the petitioner.

Learned counsel for the petitioner submits that the issue with regard to validity of the certificate is a pretext of the respondents not to finalize the promotion of the petitioner. Counsel for the petitioner submits that the junior to the petitioner have been granted promotion and consequential benefit and name in the of pending vigilance enquiry they are keeping the matter pending, although the certificate

Patna High Court CWJC No.17883 of 2016 dt.19-04-2018 2/2 has been certified to be genuine by the University from where the petitioner has obtained certificate.

In view of the above, the writ application is disposed of with a direction to the respondents to grant promotion to the petitioner with all the consequential benefits within a maximum period of 60 days from the date of receipt/production of the copy of this order. In the event, any adverse report is submitted by the Vigilance, liberty shall be available to the respondents to act in accordance with law after opportunity of hearing to the petitioner.
