The learned counsel for the petitioner submits that though the petitioner has purchased the land in question by a registered sale deed but nonetheless, Encroachment case no. 15 of 2019-20 has been initiated by the court of Circle Officer, Patna Sadar, wherein, by a notice dated 25.07.2019, the petitioner has been directed to file her show cause reply and in pursuance to the same, the petitioner has filed her reply on 21.08.2019 showing that the petitioner is the bonafide purchaser of the land in question by means of a registered sale deed. 2.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to dispose off the present writ petition with a direction to the aforesaid Circle Officer to pass final orders under Section 6 of the Bihar Public Land Encroachment
Patna High Court CWJC No.20230 of 2019 dt.17-10-2019 2/2 Act, 1956 in the ongoing Encroachment case no. 15 of 2019-20, after considering the objection filed by the petitioner dated 21.08.2019.
It is needless to state that till the passing of the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, status quo exiting as on today, shall be maintained.
