2. The petitioner has preferred this application for grant of regular bail in connection with Rohtas (Cyber) P.S. Case No. 22 of 2024 dated 18.06.2024 registered for the offences punishable u/ss 379 and 420 of the Indian Penal Code and u/ss 66(c) and 66(D) of the I.T. Act.

3. As per the prosecution case, the informant received telephonic call on 06.06.2024 from mobile no. 7860892128 and he was informed that his Bua was hospitalized and she needs money to perform operation. He was informed that her uterus was to be operated and if money was not deposited then the operation would not be performed and he was instructed to

Patna High Court CR. MISC. No.70645 of 2024(2) dt.07-10-2024 2/3 manage money. It is further alleged that Rs. 7,000/- was transferred on Phonepay number 7538832591 by the informant. It is further alleged that after transferring the said money, the mobile was found switched off and after some time, when the informant contacted on the same mobile number, he was informed from the other side that he is out of hospital then the informant raised suspicion, the informant sent his father but he could not find the said person in the hospital then again he was told that the said hospital is at Sundarpur. Then, he went there but the said hospital could not be found. Thereafter, the informant's father informed him that the fraud was done with them.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. It is further submitted that the call was made by mobile no.- 7860892128 which does not belong to the petitioner. It is further submitted that from the case diary, it appears that the said mobile number is of the co-accused, Rajiv Choubey who is the main accused. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Rohtas at Sasaram in connection with Rohtas (Cyber) P.S. Case No. 22 of 2024.

7. The application stands allowed.
