Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 363 and 365 of the Indian Penal Code.

As per the prosecution case, some unknown miscreants are alleged to have abducted the minor brother of the informant who was going to Kabaiya Coaching Centre for study. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The name of the petitioner

Patna High Court CR. MISC. No.64686 of 2022(2) dt.23-03-2023 2/2 has sprung up in the confessional statement of the co-accused Badal Kumar who has already been granted bail by the Coordinate Bench vide order dated 20.05.2022 passed in Cr. Revision. No. 550 of 2021. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 28.07.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Lakhisarai P.S. Case No. 577 of 2020.

The application stands allowed.
