JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Sikty P.S. Case No.117 of 2014 registered under Sections 420, 406, 409 and 120B/34 of the Indian Penal Code. It is contended that the petitioner is not named in the FIR. The named accused persons, namely, Lalit Kumar Thakur and Binod Kumar Yadav have already been granted bail vide orders dated 16.2.2015 and 10.3.2015 passed in Cr. Misc. No.6171 of 2015 and Cr. Misc. No. 9216 of 2015 respectively by a coordinate Bench of this Court. It is further contended that though the petitioner was secretary of the school, she was later on removed and in her place another secretary was appointed. It is

Learned counsel for the State has contested the matter and opposed the application filed on behalf of the petitioner under section 438 of the Code of Criminal Procedure. Regard being had to the fact that the named FIR accused persons have been granted bail and the name of the petitioner, who is lady, transpired subsequently in course of investigation, in event of arrest or surrender in the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Sikty P.S. Case No.117 of 2014 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
