NILU AGRAWAL ORAL ORDER 25-11-2016 Heard the learned counsel for the petitioner and the learned APP for the State.

Petitioner is languishing in judicial custody since 09.09.2016 in connection with Bodh Gaya P.S.Case No.299 of 2016 for offence alleged under Sections 363 and 366(A) of the IPC.

The prosecution lodged against unknown is that the daughter of the informant is traceless since 28.07.2016. It has been submitted by the learned counsel for the petitioner that he is innocent and as per the statement of the victim girl, Anjali Kumari under Section 164 Cr.P.C both the petitioner and the victim girl have married. He submits that the victim girl has stated in her statement that her age is 18 years, although the

Patna High Court Cr.Misc. No.50218 of 2016 (3) dt.25-11-2016 2/2 Magistrate has noted the age of 17 years. He submits that chargesheet has already been submitted against the petitioner, hence there is no chance of tampering with the evidence. However, learned APP for the State opposes the prayer for bail.

Be that as it may, considering the statement of the victim girl under Section 164 of the Cr.P.C., let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gaya in connection with Bodh Gaya P.S.Case No.299 of 2016.
