JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in for the offences punishable under Sections 279/337/338/307/353/427 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

From a four-wheeler, foreign liquor was recovered when the four-wheeler dashed against the motorcycle on 01.09.2016.

Submission of the petitioner is that the impugned order would reveal that prayer for bail has been refused only due to recovery of the foreign liquor; whereas on the date of alleged recovery possession of foreign liquor was not an offence. Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.48894 of 2016 (2) dt.21-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul/Successor Court, in connection with Supaul P.S. Case No.432 of 2016.
