The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code. Prosecution case is that the police received an information that some persons were cheating money from the people to become the agents of shopping company in lucky draw and were collecting the money, on that police raided the place, three persons apprehended but the petitioner and other succeeded in fleeing away from the spot.

Learned counsel for the petitioners submits that the petitioners have made accused in this case only on the basis of

Patna High Court CR. MISC. No. 70231 of 2019(3) dt.18-11-2019 2/2 disclosure statement of the co-accused. The petitioner no. 1 has got no criminal antecedent and petitioner no. 2 has got two criminal antecedents mentioned in para 3 of the bail application. The co-accused have been granted by anticipatory bail by the Co-ordinate Bench of this Hon'ble Court vide order dated 12.06.2019 in Cr. Misc. No.14985/2019 and dated 28.08.2019 in Cr. Misc. No. 53983/2019.

In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., J.M.-1, Sheikhpura, in connection with Sheikhopur Sarai P.S. Case No. 04 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
