2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 352, 351(2), 303(2), 190, 191(2) and 191(3) of the B.N.S..
3. The prosecution case, in brief, is that all the 6 F.I.R. named accused persons, including these petitioners and about 20 unknown persons came to the house of informant, assaulted informant and his brother and mother and snatched Rs. 4,50,000/- from the pension amount of informant's mother.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.65884 of 2025(2) dt.18-09-2025 2/3 behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, Petitioner No. 1 is son of Sarhu (brother-in-law) of informant and Petitioner No. 2 is Sala (brother-in-law) of informant and due to matrimonial dispute between informant and his wife, petitioners have falsely been implicated in this case. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against these petitioners. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, relationship between the parties, backdrop of the incident, general and omnibus nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Patna in connection with Jakkanpur P.S. Case No. 483 of 2025, subject
