2. The petitioner seeks bail in Lakhisarai P.S. Case No. 460 of 2024 registered for the offence punishable under Sections-319(2), 318(4), 338, 336(3), 340(2), 61(2) of the Bhartiya Nyay Sanhita, 2023 and Section-10 of Bihar Examination Act, 1981.

3. It is alleged that on the basis of forged ID, the petitioner impersonated himself to be a Biometric employee at Lakhisarai centre in an examination which was being conducted by BPSC.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The falsity of the present case is more evident from the fact that the police themselves have stated that they arrested

Patna High Court CR. MISC. No.68964 of 2024(2) dt.07-10-2024 2/2 the petitioner from the alleged place of occurrence i.e. at the examination centre alongwith other accused persons. It has further been submitted that the petitioner is a bona fide student and was present at the examination centre. The petitioner is a person of clean antecedent and is in custody since 21-07-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 460 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.

7. Before accepting the bail bonds, the criminal antecedent of the petitioner shall be verified and if, it is found that he is involved in any case other than the present one, his bail bonds shall not be accepted.
