JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under section 341, 354, 504, 506 of the Indian Penal Code and Section 66(C)(D) of I.T. Act.

It is alleged by the informant that the petitioner has been following her and used to harass and tease her. He is also sending messages on her mobile and threatened to implicate her in a false case if she made any revelation.

The petitioner submits that in fact the informant developed intimacy with him and they used to talk on phone. In support of his submission, he also annexed photograph.

Counsel for the State submits that though the two have fallen apart, still the petitioner is chasing her.

No.49234 of 2015 (2) dt.15-12-2015 Having regards to the facts and circumstances of the case, the petitioner Asif Khan is directed to be released on anticipatory bail, in the event of his arrest/surrender, on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Patna in Digha P.S. Case No.239 of 2015 (G.R. No.5119 of 2015), subject to the conditions that the petitioner would not physically absent himself for two consecutive dates at a stretch till the stage of framing of charge. The petitioner would report to the concerned Police Station once in every month and would submit a report to the aforesaid effect in the Court.
