JUSTICE ARUN KUMAR ORAL ORDER 14-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barachatti P.S.Case No. 491 of 2017 registered under Sections 4 and 21 of the Mines & Minerals (Development & Regulation) Act, 1957, Sections 4 and 40 of Bihar Minor Mineral Concession Rules, 1972 and Sections 4, 5(a), 5(c) and 8(a) of the Bihar Minerals (prevention of Illegal Mining, Transportation and Storage) Rules, 2003.
Allegation is that illegal sand mining was being done and loaded on the tractor and the petitioner is the driver of the said truck.
Learned counsel for the petitioner submits that petitioner is merely a driver of the tractor owner and he has no concern with the illegal mining and has no criminal antecedent and has been
Patna High Court Cr.Misc. No.57688 of 2017 (2) dt.14-12-2017 2/2 in custody since 14.08.2017.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Arbind Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.D.J.M., Sherghati, Gaya in connection with Barachatti P.S. Case No. 491 of 2017.
