The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323 and 307/34 of the Indian Penal Code.

The prosecution case is that co-accused Surendra Manjhi had taken rupees ten thousand as loan from the informant but when the informant demanded the same then three accused persons including the petitioner assaulted the son of the informant with dagger and Farsa. While the informant provided medical assistance to his son when co-accused Surendra Manjhi lodged Gopalpur P.S. Case No. 53 of 2015 levelling accusation under Sections 341, 324, 307, 504 IPC and 3(1)(x) of SC/ST

It is submitted by learned counsel for the petitioner that the accusation of assault to the son of the informant is not specific. The petitioner lodged case at earlier point of time and the petitioner while pacifying the dispute between the informant and Surendra Manjhi received grievous injury at the hands of the son of the informant. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Gopalganj in connection with Gopalpur P.S. Case No. 57 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
