The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 376 and 120B of the Indian Penal Code and section 4 of The Protection of Children from Sexual Offences Act, 2012. The prosecution case is that Awadhesh Sahani established physical relationship with the informant since 7-8 months prior to the lodging of the case and took her to different places in the country. Subsequently, the informant got pregnant but the petitioner being the mother of Awadhesh Sahani helped him to get married with some other girl. It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.51102 of 2015 (2) dt.09-11-2015 2/2 petitioner that the thrust of accusation is against Awadhesh Sahani and the petitioner has been roped in the present case only because she is the mother of Awadhesh Sahani. Moreover, in 164 Cr.P.C. statement the informant has not alleged anything against the petitioner.
Considering the thrust of accusation against Awadhesh Sahani and petitioner being a lady let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge - cum- Special Judge, POCSO Act, Muzaffarpur in connection with Minapur P.S. Case No. 263 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
