The petitioner seeks bail in connection with Sikandra P.S. Case no. 205 of 2016 registered for the offence punishable under Sections 419, 420, 467, 468, 471, and 120-B/34 of the Indian Penal Code.

The petitioner along with other accused persons in collusion with each other are said to have withdrawn money of MGNREGA depositing in the fake bank account of 15 persons by getting the said account opened.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be Rojgar Sevak and his duty is only to issue cheque for work of MGNREGA project. He

Patna High Court Cr.Misc. No.53994 of 2017 (2) dt.15-11-2017 has played no role in the alleged occurrence. There is nothing in the record indicating complicity of the petitioner in the occurrence barring confessional statement of accused namely, Gayan Ranjan and Statish Kumar. Both the aforesaid accused have been enlarged on bail by a co-ordinate Bench of this Court vide order vide order dated 08.04.2017 passed in Cr. Misc. no. 14032 of 2017 and order dated 07.07.2017 passed in Cr. Misc. no. 21701 of 2017. The petitioner has been languishing in custody since 07.09.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-2nd, Jamui in connection with Sikandra P.S. Case no. 205 of 2016.
