Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 341, 323, 354(B), and 379/34 of the Indian Penal Code and Section 3/4 ( Prevention of Witchcraft), Act.

It has been submitted on behalf of the petitioner that the petitioner is the own Bhainsur (elder brother-in-law) and whatever that has been alleged against him could not be expected from a Bhainsur. He has been implicated in the present due to existing family dispute and the whole prosecution case is false and concocted.

Patna High Court Cr.Misc. No.49650 of 2016 (2) dt.19-12-2016 2/2 Having heard both sides and in view of the accusations levelled against the petitioner in the First Information Report, I am not inclined to grant the petitioner, the prayer for bail, it is accordingly rejected.

However, if the petitioner surrenders before the Court below within a period of four weeks, his prayer for regular bail may be considered by the learned Court below on its own merit, without being prejudiced by this order.
