This is an application for grant of anticipatory bail in connection with Kishanganj P.S. Case No. 348 of 2017 registered for the offence punishable under Sections 419, 420, 406, 467, 323, 468, 471 and120B of the Indian Penal Code. The allegation is that the petitioner herein along with other were trying to withdraw the insurance sum pertaining to the insured who had already died before, by manufacturing his death certificate in a date subsequent to the taking of the policy by the said deceased person.
The learned counsel for the petitioner submits that no loss has been caused to the insurance company inasmuch no money has been given to the legal heirs of the insured. It is further
Patna High Court Cr.Misc. No.60328 of 2017(4) dt.02-02-2018 2/2 submitted that the petitioner is ready to join investigation and he is having a clean antecedent.
Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioners herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 348 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
It is further directed that the petitioner shall join the investigation and cooperate with the Investigation Agency during the investigation, failing which the prosecution shall be free to approach this Court for cancellation of the privilege of anticipatory bail being granted to the petitioner.
