JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,379,354 and 504/34 of the Indian Penal Code.

The prosecution case is that co accused Raju Malakar asked the father of the informant to shave his beard, on refusal of the same he assaulted the father of the informant when the informant made protest then Raju pushed the informant down and started assaulting with fists and slaps. It is also alleged that the petitioner assaulted the informant with danda and snatched her gold ear-ring and chain and tore her clothes. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against co accused Raju and the

Patna High Court Cr.Misc. No.49591 of 2015 (2) dt.06-11-2015 2/2 petitioner has been roped in the present case since he happens to be the driver of co accused Raju. The injury of the informant has been found to be simple. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation and the statement that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada in connection with Mufassil P.S. Case No.27 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
