The petitioner seeks pre-arrest bail in connection with Jamhore P.S. Case No. 70 of 2015 registered under Section 414/34 of the Indian Penal Code as well as Sections 2(E), 3(8), 15 and 18 of the Mahua Flowers Act.
Regard being had to the violation of Rule 3 of the Bihar Excise (Mahua Flowers) Rules, 2006 punishable under the Excise Act, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application filed on behalf of the petitioner is rejected.
In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in
Patna High Court Cr.Misc. No.50614 of 2015 (2) dt.06-11-2015 2/2 any manner by this order.
