Petitioner apprehends arrest in connection with Bidpur P.S. Case No. 11 of 2023 registered for the offence punishable under 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from a place situated in south of Mata Mandir, which is an open place. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.68373 of 2023(2) dt.01-11-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing personal bond to the satisfaction of Additional Sessions Judge Icum-Exclusive Excise Court, Vaishali at Hajipur in connection with Bidpur P.S. Case No. 11 of 2023 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
