Petitioner seeks bail in a case registered for the offences punishable under Sections 364 and 201/34 of the Indian Penal Code.
Allegation against the petitioner is that he committed murder of Sunita Kumari, the second wife of the petitioner for the reason that she had not given birth to a male child, though she was pregnant and mother of a female child. Submission of the learned counsel for the petitioner is that Sunita Kumari had some affairs with other man, hence, she fled away.
The case diary would reveal that such type of statement has come from some independent witnesses.
Patna High Court Cr.Misc. No.54334 of 2017 (5) dt.02-01-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marauna Police Station Case No. 95 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
