JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 395 of the I.P.C.

The prosecution story, in brief, is that on the alleged date and time of occurrence 20-25 unknown miscreants armed with country made pistol and danda came in the house of the informant and looted articles, such as gold and silver ornaments, clothes, ATM cards, T.V. and cash Rs.65000/-. It has been submitted on behalf of the petitioner that the petitioner is in custody since 4.9.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court Cr.Misc. No.50359 of 2016 (3) dt.15-12-2016 named in the F.I.R. He has not been put on T.I.P. to ascertain his involvement in the present case. The other co-accused has been granted bail vide Cr.Misc.No.50940 of 2016.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S. case No.150 of 2016.
