2. The petitioner seeks anticipatory bail in connection with Ram Nagar P.S. Case No. 245 of 2023 registered for the offence under Sections 120, 201, 120B/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner along with other accused persons is said to have participated in the killing of the deceased.

4. The bail application of the similarly situated coaccused namely Sameer Khan and Vikash Kumar has been rejected by this Court.

5. The petitioner was seen with the deceased as has come in the statement of the independent witnesses in the case diary in Paragraph nos. 8 and 9.

6. In the facts of the case, this is not a fit case for grant of anticipatory bail.

7. Accordingly, this application is dismissed.

8. The petitioner is directed to surrender and pray for regular bail within two weeks from today. If the petitioner does not surrender within two weeks from today then the Superintendent of Police, Bagaha will take all steps for arrest of the petitioner.

9. Interim order dated 18.10.2023 is hereby recalled.

10. Let a copy of this order be communicated to the Superintendent of Police, Bagaha through FAX for its compliance.
