This is an application for grant of anticipatory bail in connection with Birupur P.S. Case No. 15 of 2016 registered for the offence punishable under Sections 147, 148, 149, 307, 385, 387 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
The allegation against the accused persons including the petitioner herein is regarding assaulting the prosecution side and resorting to gun shot firing.
The learned counsel for the petitioner submits that the petitioner has been falsely implicate in the present case. I find from paragraph-3 of the present petition that the petitioner has as many as four cases pending against him and his antecedent is very bad.
Patna High Court Cr.Misc. No.59844 of 2017 (4) dt.24-01-2018 2/2 In such view of the matter, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition for anticipatory bail is rejected.
However, it is directed that in case the petitioner surrenders within a period of four weeks from today and prays for regular bail, the same would be considered on its own merit without being influenced by the present rejection of the anticipatory bail petition.
The petition is disposed off.
