Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Isuapur PS case no. 173 of 2024, disclosing offences punishable under Sections 115(2), 126(2), 118(4), 351(2), 352, 191(2), 190, 121(1), 121(2), 132, 324(2), 223 of the Bharatiya Nyaya Sanhita, 2023 and Sections 3/4of Damage to Public Property Act.

The prosecution story, as per the First Information Report lodged by Revenue Officer, Ward No. 15, Jairam Bazar, Khagaul, Patna, is that on 22.07.2024, a meeting was being held between two communities in connection with the illegal construction upon the gair majarua aam land. In the meanwhile, both the communities started hot arguments and pelting stones, abusing government officers and also damaging the government
Patna High Court CR. MISC. No.67973 of 2024(2) dt.24-10-2024 2/3 properties, due to which, many persons sustained injuries and the traffic was also obstructed. After a great effort, the Mahal Chowkidar, on the basis of information collected from the villagers about the persons involved in vandalism, came to know that the petitioner along with other accused persons including 100 unknown persons were involved in vandalism. 4.
Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village politics. Learned counsel further submits that petitioner's name has been disclosed by the Mahal Chowkidar on the basis of information collected from the villagers. He next submits that the petitioner is a student and right now studying in M.Sc. III Semestar, which would be evident from Annexure-P/2, annexed to this application.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is a student of M.Sc. having no criminal antecedents, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be

No.67973 of 2024(2) dt.24-10-2024 3/3 released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st class, Sara at Chapra in connection with Isuapur PS case no. 173 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
