JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 392 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.
When the criminals were committing loot in the shop of the informant, co-accused Anjar Alam was apprehended and from his possession one loaded pistol and one stolen motorcycle were recovered. Petitioner's name surfaced on the basis of confessional statement of co-accused Anjar Alam. Petitioner is in custody since 30.07.2016.
Co-accused Anjar Alam has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.12645 of 2017.
Patna High Court Cr.Misc. No.50686 of 2016 (8) dt.19-04-2017 2/2 Learned Additional Public Prosecutor submits that some cash said to be looted items were recovered from the house of the petitioner also.
Considering the period already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura/Successor Court, in connection with Madhepura P.S. Case No.430 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
